2. Prohibited Activities and Behaviors

You are expressly prohibited from:

  • 2.1 Using our lab environments or course materials to launch attacks against any systems outside our authorized training infrastructure
  • 2.2 Attempting to gain unauthorized access to our systems, networks, or other users' accounts
  • 2.3 Distributing malware, viruses, or any malicious code through our platform
  • 2.4 Engaging in any form of harassment, discrimination, or abusive behavior toward instructors or other students
  • 2.5 Reverse engineering, decompiling, or attempting to extract source code from our platform or materials
  • 2.6 Using automated systems or bots to access our services without authorization

3. Content Guidelines and Restrictions

All content you create or share must:

  • 3.1 Be respectful, professional, and appropriate for an educational environment
  • 3.2 Not violate any intellectual property rights, including copyrights, trademarks, or patents
  • 3.3 Not contain offensive, defamatory, or discriminatory material
  • 3.4 Not disclose confidential information or trade secrets belonging to others

4. Age Restrictions and Requirements

You must be at least 18 years of age to use our services. By creating an account or enrolling in courses, you represent and warrant that you meet this age requirement. We reserve the right to verify your age and terminate accounts of users who do not meet this requirement.

User Responsibilities

5. Indemnification Obligations

You agree to indemnify, defend, and hold harmless SecureNet Institute, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to your use of our services, violation of these Terms and Conditions, violation of any rights of third parties, or any misuse of knowledge or skills acquired through our courses.

  • 8.2 Warranties regarding the accuracy, reliability, or completeness of course content
  • 8.3 Warranties that our services will be uninterrupted, secure, or error-free
  • 8.4 Warranties regarding specific career outcomes or certification success

While we strive to provide high-quality training, we make no guarantees about employment prospects, salary increases, or certification exam passage rates.

9. Limitation of Liability

To the maximum extent permitted by law, SecureNet Institute shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • 9.1 Loss of profits, revenue, data, or business opportunities
  • 9.2 Costs of procuring substitute services or training
  • 9.3 Damages arising from unauthorized access to or use of our servers or personal data
  • 9.4 Any other damages arising from your use of or inability to use our services

Our total liability to you for all claims arising from or related to our services shall not exceed the amount you paid to us for the specific service giving rise to the claim during the twelve months preceding the claim.

10. Consequential Damages Exclusion

Under no circumstances shall SecureNet Institute be liable for any damages that result from your misuse of knowledge or skills acquired through our courses, including but not limited to damages arising from unauthorized computer access, cybercrime, or violations of applicable laws. You assume full responsibility for the ethical and legal application of skills learned through our training.

11. Force Majeure Provisions

We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, governmental actions, labor disputes, power failures, or telecommunications failures. In such events, our obligations shall be suspended for the duration of the force majeure circumstance.

Legal Information and Dispute Resolution

12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Tokyo for the resolution of any disputes arising from or related to these terms or your use of our services.

13. Dispute Resolution Procedures

In the event of a dispute, you agree to the following resolution process:

  • 13.1 Initial contact: Notify us in writing of your dispute with detailed information
  • 13.2 Good faith negotiation: Both parties will attempt to resolve the dispute through good faith negotiations for 30 days
  • 13.3 Mediation: If negotiations fail, both parties agree to participate in mediation before pursuing formal legal action
  • 13.4 Legal action: Only after exhausting mediation may either party pursue formal legal proceedings

14. Severability Clause

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these terms. The remaining provisions shall continue in full force and effect.

15. Terms Modification Policy

Material changes will be communicated to enrolled students via email or platform notification at least 14 days before taking effect. Changes to payment terms, refund policies, or liability limitations will require your explicit consent if you have an active enrollment. Your continued use of our services after changes become effective constitutes acceptance of the modified terms.

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Cookie Policy, and any enrollment agreements, constitute the entire agreement between you and SecureNet Institute regarding your use of our services. These terms supersede any prior agreements, communications, or understandings, whether written or oral.

17. Assignment and Transfer

You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations under these terms to any affiliate or successor entity without restriction.

18. Waiver

Our failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision or our right to enforce it in the future. Any waiver must be in writing and signed by an authorized representative of SecureNet Institute.
